How will you locate the debtor?
We have the ability to access information sources that will provide us everything we need to know about the judgment dead beat and their assets. We are highly skilled in finding all the necessary information required to locate the dead beat and to recover the money.
What if you cannot find any assets belonging to the debtor?
If there are no assets available, we will complete another assessment after a few months or so to determine whether we should resume.
How long does it take to know what the outcome will be?
No two cases are the same. Some people are very experienced with hiding their assets. Normally we should have some results for you within a few weeks, but in an extreme case maybe 30 days or sometimes longer.
Why should I choose you over a lawyer?
If you are willing to foot the cost of a retainer and pay a fee of $150 to $250 per hour, then you may decide to go with a lawyer. However, please be advised that you have to pay the retainer regardless of if the judgment is recovered. Remember...with AFR – No recovery – No charge.
Why not simply use a collection agency?
Because of the Fair Debt Collection Practice Act, the dead beat has a legal right to tell the collection agency to cease all communications. However, AFR becomes the legal assignee of the judicial judgment with a legal right to pursue and enforce the judgment. Therefore, the Fair Debt Collection Practices Act does not affect us the same way it would a collections agency.
How does this work?
First, you will need to call us to discuss the judgment. Please be aware we may have to request that you fax over a copy of the judgment or you can simply fill out the "Submit Application" form to submit all information. We will review the judgment and conduct a judgment assessment. After completion of your judgment assessment you will be contacted to discuss the judgment. Please allow up to 24 hours.
If we have determined that the judgment is enforceable, we will send you the necessary forms to assign the judgment to AFR. There are two documents that you will need to get signed and notarized. The first one is an "Assignment of Judgment". This is a document that I will file with the court that will transfer the Judgment into my name so I can take legal action on the judgment". The second is a contract between you and I that says I will make payment to you based on the funds recovered from the judgment dead beat, per our agreement.
